These Terms of Service govern access to and use of WorkSmarter.
By accessing or using WorkSmarter, you agree to these Terms of Service. If you do not agree, do not use the platform.
WorkSmarter provides tools for AI-assisted product work, including PRD generation, backlog refinement, roadmap planning, retrospectives, planning poker, Jira-related workflows, and related collaboration features.
The platform provides software tools and AI-generated output for informational and operational assistance only. WorkSmarter does not provide legal, financial, compliance, employment, security, or professional advice, and does not guarantee correctness, completeness, fitness for purpose, uninterrupted availability, or business outcomes.
You are solely responsible for reviewing, approving, rejecting, editing, and using any content, recommendations, estimates, action items, Jira changes, or AI-generated output before relying on it. You assume full responsibility for decisions, actions, losses, claims, and consequences arising from your use of the platform.
You agree not to misuse the service, upload unlawful or infringing material, interfere with the platform, attempt unauthorized access, or use the service in violation of any law, regulation, contract, or third-party right.
The platform may integrate with or rely on third-party services such as Jira, payment processors, authentication providers, hosting providers, and AI systems. WorkSmarter is not responsible for outages, data loss, errors, decisions, policies, or actions of any third-party service.
If the platform offers paid credits or paid features, purchases are final except where required by law. You are responsible for reviewing pricing and usage before purchase. Unused credits, service interruptions, or dissatisfaction with generated outputs do not create any guarantee of refund, compensation, or liability unless required by applicable law.
To the maximum extent permitted by law, the platform is provided on an 'as is' and 'as available' basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, security, or reliability.
To the maximum extent permitted by law, WorkSmarter and its owner, operators, affiliates, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or business-related damages, including lost profits, lost data, service interruptions, reputational harm, project delays, or procurement of substitute services, arising from or related to your use of the platform.
You agree to defend, indemnify, and hold harmless WorkSmarter and its owner, operators, affiliates, contractors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses arising out of your content, your data, your connected accounts, your use of the service, or your violation of these Terms or any law or third-party rights.
We may suspend, restrict, or terminate access at any time, with or without notice, for any reason including misuse, risk, nonpayment, suspected unlawful activity, or protection of the platform and its users.
We may update, change, suspend, or discontinue any part of the service or these Terms at any time. Continued use after changes means you accept the updated Terms.
These Terms are governed by the laws applicable in the operator’s jurisdiction, without regard to conflict of law principles, unless mandatory local law requires otherwise.
